Willamette Sauna Haus Waiver and Release of Liability
Business Name: Willamette Sauna Haus, LLC.
1. Acknowledgment of Services and Voluntary Participation
I acknowledge that I am voluntarily participating in activities and services offered by Willamette Sauna Haus, LLC (hereinafter referred to as "Willamette Sauna Haus"), which may include, but are not limited to: use of sauna, cold plunge tub, shower, rest and relaxation areas, and participation in wellness-related events or experiences. I understand that these services may be provided at the Willamette Sauna Haus premises, at a customer location, or at any event, festival, rally, private gathering, or other location where Willamette Sauna Haus operates.
2. Assumption of Risk
I understand and acknowledge that participation in these activities involves inherent risks, including but not limited to: dehydration, overheating, burns, slips, trips, falls, fainting, cold shock response, aggravation of pre-existing conditions, equipment-related injuries, transportation-related hazards associated with mobile facilities, other related injuries, and the potential for serious injury, illness, or death.
I understand that the sauna and cold plunge involve exposure to extreme temperatures that may not be suitable for everyone. I voluntarily assume all risks and responsibilities associated with participating in these activities. I agree to follow all safety instructions and act in a safe and prudent manner.
3. Medical Acknowledgment
I represent that I am physically fit and do not have any medical condition that would prevent my safe participation. I understand that I should consult a physician before engaging in any activities at Willamette Sauna Haus, especially if I have high blood pressure, cardiovascular disease, respiratory issues, am pregnant, or have any other chronic health conditions.
I acknowledge that Willamette Sauna Haus does not provide medical advice or supervision, and that the use of facilities is unsupervised and undertaken at my own risk. I understand that staff may not be present at all times. I will exit the sauna or cold plunge tub immediately if I experience any discomfort, nausea, dizziness, pain, difficulty breathing, or other symptoms.
I understand that participation in sauna, cold plunge, and related wellness activities is entirely voluntary and that I am solely responsible for monitoring my own physical condition and comfort level throughout my visit. I may discontinue participation, leave the sauna or cold plunge, or otherwise end my session at any time and for any reason. I acknowledge that Willamette Sauna Haus does not require or encourage any guest to remain in a sauna, cold plunge, or other activity beyond their personal comfort level or physical capability.
I understand that in the event of an emergency, I am responsible for seeking assistance and contacting emergency services.
4. Release and Waiver of Liability
In consideration of being allowed to use the services, facilities, equipment, and activities provided by Willamette Sauna Haus, whether at its premises, a customer location, or any other location where services are provided, I hereby release, waive, discharge, and hold harmless Willamette Sauna Haus, its owners, employees, volunteers, affiliates, agents, contractors, and representatives from any and all claims, liabilities, demands, actions, causes of action, damages, losses, costs, or expenses arising out of or related to any injury, illness, loss, damage to person or property, disability, or death that may be sustained while participating in activities or using services provided by Willamette Sauna Haus, whether caused by negligence or otherwise, to the fullest extent permitted by law.
I acknowledge that Willamette Sauna Haus is not responsible for any personal property that is lost, stolen, or damaged while attending or participating in any activity or event.
5. Indemnification
I agree to indemnify, defend, and hold harmless Willamette Sauna Haus, its owners, employees, volunteers, affiliates, agents, contractors, and representatives from any and all claims, actions, suits, proceedings, costs, expenses, damages, liabilities, and attorney's fees arising from or related to my participation in activities or use of services provided by Willamette Sauna Haus.
6. Use of Facilities and Conduct
I agree to follow all rules, policies, posted signage, and instructions provided by staff and to act responsibly while using the facilities and equipment. I understand that failure to do so may result in removal from the premises or event without refund.
I understand that no alcohol, illegal drugs, or intoxicating substances are permitted on-site and that entering the sauna, cold plunge, or related facilities while impaired or under the influence of alcohol or drugs is prohibited.
I understand that sauna stoves, heater components, sauna rocks, metal surfaces, steam, and surrounding areas may become extremely hot during operation and can cause burns or other injuries upon contact. I agree not to touch, lean on, sit on, place personal belongings on, or otherwise interfere with the sauna stove, heater, rocks, or associated heating equipment.
I acknowledge that it is my responsibility to exercise caution while using the facilities and to supervise any minor children in my care at all times. Willamette Sauna Haus shall not be liable for any burns, injuries, damages, or losses resulting from contact with the sauna stove, heater, rocks, hot surfaces, steam, or related equipment, whether caused by my own actions, the actions of a minor under my supervision, or the actions of any other participant.
Only water supplied or approved by Willamette Sauna Haus may be poured onto sauna rocks or heating equipment. Guests may not add essential oils, fragrances, beverages, herbs, or any other substances to the sauna stove, rocks, water buckets, or heating equipment.
I agree to use all facilities and equipment only for their intended purposes and in accordance with all posted instructions and safety guidelines.
7. Photo & Media Release
I grant Willamette Sauna Haus permission to use photographs, video footage, audio recordings, or other media depicting me that are taken during my visit or participation in any Willamette Sauna Haus activity, event, or service for marketing, advertising, promotional, educational, or business purposes, including use on websites, social media platforms, digital advertising, print materials, and other publications.
I transfer to Willamette Sauna Haus any rights, title, or interest I may have in such images or recordings and understand that I will not receive compensation for their use. If I do not wish to be photographed or recorded, I will notify staff prior to participation.
Guests are welcome to take personal photos or videos for personal use and social media sharing, provided they obtain consent from any other individuals who may appear in the content.
8. Acknowledgment of No Guarantees or Results
I understand that participation in sauna, cold plunge, and wellness-related activities does not guarantee any specific health, fitness, recovery, therapeutic, or wellness outcome. Any statements regarding potential benefits are informational in nature and should not be interpreted as medical advice.
9. Governing Law
This waiver shall be governed by and interpreted in accordance with the laws of the State of Oregon. If any provision of this waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
I CERTIFY THAT I AM 18 YEARS OF AGE OR OLDER, OR THAT I AM THE PARENT OR LEGAL GUARDIAN OF THE MINOR PARTICIPANT IDENTIFIED BELOW. I HAVE CAREFULLY READ THIS WAIVER AND RELEASE OF LIABILITY, FULLY UNDERSTAND ITS CONTENTS, AND SIGN IT FREELY AND VOLUNTARILY. IT IS MY INTENTION TO RELEASE AND HOLD HARMLESS WILLAMETTE SAUNA HAUS, LLC TO THE FULLEST EXTENT PERMITTED BY LAW.
IF THE PARTICIPANT IS A MINOR, A PARENT OR LEGAL GUARDIAN MUST SIGN BELOW.
10. Parental Release of Liability
In consideration of the minor child being permitted to utilize Willamette Sauna Haus services, amenities, equipment, facilities, activities, and other offerings, I accept and agree to all terms and conditions contained in this Release on behalf of the minor participant.
11. Parental Indemnification
I agree to release, indemnify, defend, and hold harmless Willamette Sauna Haus, LLC from all claims, liabilities, damages, losses, costs, and expenses arising from or related to the participation of any minor child for whom I am responsible, including claims brought by or on behalf of such minor.
12. Parental Representation of Authority
I represent and warrant that I am the parent or legal guardian of the minor participant or otherwise possess legal authority to execute this Release on the minor's behalf. I further represent that all parents and/or legal guardians with legal rights concerning the minor have authorized or consented to the execution of this Release.
I HAVE FULLY INFORMED MYSELF OF THE CONTENTS OF THIS RELEASE BY READING IT BEFORE SIGNING IT. BY MY SIGNATURE BELOW, I UNDERSTAND AND AGREE TO THE ABOVE TERMS AND CONDITIONS AND TO ALL CURRENT POLICIES OF WILLAMETTE SAUNA HAUS, LLC, WHICH I HAVE READ. THESE POLICIES MAY BE UPDATED OR MODIFIED FROM TIME TO TIME AT THE SOLE DISCRETION OF WILLAMETTE SAUNA HAUS, LLC.
